• A. We set these rules to ensure the highest quality of service and safety for all our guests. By maintaining a professional standard, we can focus 100% on providing you with an unforgettable experience with us.
• (A. Kami menetapkan aturan ini demi memastikan standar kualitas layanan dan keamanan tertinggi bagi seluruh tamu kami. Dengan menjaga standar profesional ini, kami dapat fokus 100% untuk memberikan Anda pengalaman yang tak terlupakan bersama kami).
• B. By paying the Down Payment (DP), the Customer is deemed to have legally entered into a binding contract and agreed to all terms below.

💰 1. BOOKING & PAYMENT POLICY (Kebijakan Pemesanan & Pembayaran)

• 1.1 Booking Deposit: A non-refundable Down Payment (DP) of 20% of the total package price is required to secure your booking.
• (1.1 Pemesanan dianggap sah jika sudah membayar Uang Muka (DP) sebesar 20% dari total harga paket. DP bersifat tidak dapat dikembalikan).
• 1.2 Fixed Price & Currency: Prices are binding upon DP receipt, except for official government-mandated fuel hikes or national park ticket increases. For international transfers, guests are responsible for all bank fees and exchange rate differences to ensure the net amount received matches the agreed IDR price.
• (1.2 Harga & Mata Uang: Harga mengikat setelah DP diterima, kecuali terjadi kenaikan resmi BBM atau tiket masuk Wisata/Taman Nasional oleh pemerintah. Peserta wajib membayar selisih kenaikan tersebut. Untuk transfer internasional, tamu bertanggung jawab atas biaya bank dan selisih kurs untuk memastikan jumlah bersih yang diterima sesuai dengan harga IDR yang disepakati).
• 1.3 Fixed Quotation & Participant Count: The total price is based on the number of participants agreed upon during booking. If the number of participants decreases, the total package price remains the same to cover fixed operational costs.
• (1.3 Total harga didasarkan pada jumlah peserta saat booking. Jika jumlah peserta berkurang, total harga paket tetap sama untuk menutupi biaya operasional tetap).
• 1.4 Payment Settlement: The remaining balance MUST be settled upon pick-up, or at least 7 days (H-7) before arrival for large groups/corporate bookings as agreed. Pigiyuk78 reserves the right to unilaterally cancel services without DP refund and without further notice if the balance is not cleared as agreed.
• (1.4 Pelunasan: Sisa pembayaran WAJIB dilunasi saat penjemputan, atau minimal H-7 sebelum kedatangan untuk rombongan besar/grup korporat sesuai kesepakatan. Pigiyuk78 berhak membatalkan layanan secara sepihak tanpa pengembalian DP dan tanpa pemberitahuan lebih lanjut jika pelunasan tidak dilakukan sesuai kesepakatan).

📅 2. CANCELLATION & MODIFICATION POLICY (Kebijakan Pembatalan & Perubahan)

• 2.1 Non-Refundable DP: The 20% Down Payment is 100% Non-Refundable for any personal reasons (e.g., flight delays, sickness, or change of plans). We strongly recommend guests to have comprehensive travel insurance.
• (2.1 DP 20% TIDAK DAPAT DIKEMBALIKAN (100% Hangus) untuk alasan pribadi apapun termasuk kendala pesawat, sakit, atau perubahan rencana. Kami sangat menyarankan tamu memiliki asuransi perjalanan).
• 2.2 No Refund for Unused Services: No refunds or price reductions will be given for pre-paid hotels, transport, or itinerary portions that the guest chooses not to use or requests to change during the trip.
• (2.2 Tidak ada pengembalian uang atau pemotongan harga untuk hotel, transportasi, atau bagian itinerary yang tidak digunakan atau diubah atas permintaan tamu di tengah jalan).
• 2.3 Modification Fees: Any request to change hotels, vehicles, or routes after booking is treated as a "New Booking" and subject to additional charges at current market rates.
• (2.3 Permintaan ganti hotel, mobil, atau rute setelah booking dianggap sebagai "Pemesanan Baru" dan akan dikenakan biaya tambahan sesuai harga pasar).

🌋 3. ACCESS & FORCE MAJEURE (Kendala Akses & Keadaan Memaksa)

• 3.1 Road Obstructions: Pigiyuk78 is not liable for obstructions beyond our control (e.g., fallen trees, landslides, road repairs, or mass protests). No refunds will be issued, our team will offer alternative destinations of comparable value based on availability and accessibility.
• (3.1 Pigiyuk78 tidak bertanggung jawab atas hambatan seperti pohon tumbang, longsor, perbaikan jalan, atau demonstrasi. Tidak ada refund biaya tour/tiket, tim kami akan menawarkan destinasi alternatif dengan nilai yang sebanding berdasarkan ketersediaan dan aksesibilitas).
• 3.2 Natural Disasters & Authorities Closure: In the event of eruptions, forest fires, or official park closures, Pigiyuk78 applies a Strict No Cash Refund Policy for all payments. This is a Force Majeure condition beyond our control. Guests may choose:
• ▪️ A. Alternative Destinations: Switch to other available destinations of comparable value (e.g., Tumpak Sewu, Ijen, or Waterfall tours). Any additional costs arising from the new route shall be borne by the guest.
• ▪️ B. Reschedule: Valid for 180 days (Trip Credit).
• ▪️ C. Non-Refundable Status: If the guest declines options A and B, all payments made are strictly non-refundable. These funds are utilized to cover non-recoverable operational costs, administrative fees, and third-party commitments. Pigiyuk78 is not responsible for any refund processing of government-managed tickets.
• (3.2 Bencana Alam & Penutupan Otoritas: Jika terjadi erupsi, kebakaran hutan, atau penutupan resmi, Pigiyuk78 menerapkan kebijakan Strict No Cash Refund (Tidak Ada Refund Tunai). Ini adalah kondisi Force Majeure di luar kendali kami. Tamu dapat memilih:
• ▪️ A. Destinasi Alternatif: Dialihkan ke destinasi lain yang tersedia dengan nilai sebanding (misal: Tumpak Sewu, Ijen, atau tur air terjun). Biaya tambahan yang timbul akibat perubahan rute baru menjadi tanggung jawab tamu.
• ▪️ B. Reschedule: Saldo perjalanan berlaku selama 180 hari.
• ▪️ C. Status Non-Refundable: Jika tamu menolak opsi A dan B, maka seluruh dana yang telah dibayarkan tidak dapat ditarik kembali dan digunakan untuk menutup biaya operasional, admin, dan komitmen pihak ketiga yang tidak dapat dibatalkan. Pigiyuk78 tidak bertanggung jawab atas pengurusan refund tiket otoritas.
• 3.3 Technical Issues & Traffic Conditions: Pigiyuk78 is not liable for delays caused by vehicle technical issues (e.g., flat tires), road accidents involving other parties, or extreme traffic congestion, as . Our team will take necessary actions to minimize delays, but no refunds or compensations will be issued for , or shortened itineraries resulting from these factors.

🛡️ 4. LIABILITY, INSURANCE & PRIVACY (Tanggung Jawab, Asuransi & Privasi)

• 4.1 Health & Travel Insurance: Pigiyuk78 does not provide personal travel insurance. Guests must ensure they are in good physical health. Pigiyuk78 is not liable for any injury, illness, death, or health complications arising from pre-existing medical conditions. Proceed at your own risk.
• (4.1 Asuransi & Kesehatan: Pigiyuk78 tidak menyediakan asuransi perjalanan. Tamu wajib memastikan mereka dalam kondisi fisik yang sehat. Kami tidak bertanggung jawab atas cedera, sakit, kematian, atau komplikasi kesehatan yang timbul dari kondisi medis yang sudah ada sebelumnya. Risiko ditanggung masing-masing peserta).
• 4.2 Damage to Assets & Loss of Income: Guests are liable for any damage to the vehicle or equipment caused by negligence or improper use. Guests must settle :
• ▪️ Full repair costs.
• ▪️ Compensation for the vehicle's downtime (Loss of Income).
• (4.2 Tamu bertanggung jawab atas kerusakan unit/alat akibat kelalaian maupun penggunaan yang tidak semestinya. Tamu wajib membayar):
• ▪️ Biaya perbaikan penuh
• ▪️ Kompensasi kerugian harian selama mobil di bengkel (Loss of Income).
• 4.3 Personal Data Privacy: Any personal data provided (IDs/Passports) will be used strictly for booking purposes in compliance with Indonesian Privacy Laws (UU PDP).
• (4.3 Data pribadi yang diberikan hanya akan digunakan untuk keperluan reservasi sesuai dengan UU Perlindungan Data Pribadi).
• 4.4 Personal Belongings & Lost and Found: Pigiyuk78 is not liable for the loss, damage, or theft of any personal belongings during the tour. Guests are solely responsible for their items. In the event of left-behind items, the guest is fully responsible for all shipping costs and any operational fees incurred for the delivery. Pigiyuk78 is not liable for the item's condition during transit via third-party couriers.
• (4.4 Barang Pribadi & Barang Tertinggal: Pigiyuk78 tidak bertanggung jawab atas kehilangan, kerusakan, atau pencurian barang pribadi milik peserta selama tour berlangsung. Tamu bertanggung jawab penuh atas barang bawaan masing-masing. Jika ada barang tertinggal, seluruh biaya pengiriman dan biaya operasional pengantaran menjadi tanggung jawab tamu. Pigiyuk78 tidak bertanggung jawab atas kondisi barang selama proses pengiriman oleh kurir pihak ketiga).

📸 5. MEDIA RIGHTS & DOCUMENTATION (Hak Dokumentasi & Media)

• 5.1 Promotional Consent: Pigiyuk78 reserves the right to take photos and videos during the tour for promotional purposes (social media, website, etc.). By participating, guests provide their consent. If you prefer not to be documented, please inform our admin or crew BEFORE the tour begins.
• (5.1 Hak Dokumentasi: Pigiyuk78 berhak mengambil foto dan video selama tour untuk keperluan promosi (media sosial, website, dll). Dengan berpartisipasi, tamu dianggap memberikan persetujuan. Jika Anda keberatan didokumentasikan, mohon informasikan admin atau kru kami SEBELUM tour dimulai).

⚖️ 6. PRIVACY & DISPUTE RESOLUTION (Privasi & Penyelesaian Sengketa)

• 6.1 Jurisdiction: Any legal disputes shall be settled through the District Court of Malang (Pengadilan Negeri Malang), East Java, Indonesia.
• (6.1 Yurisdiksi: Segala sengketa hukum akan diselesaikan melalui Pengadilan Negeri Malang, Jawa Timur, Indonesia).
• 6.2 Severability: If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
• (6.2 Keterpisahan: Jika terdapat salah satu ketentuan dalam syarat ini yang dianggap tidak sah atau tidak dapat dilaksanakan oleh hukum, ketentuan lainnya akan tetap berlaku sepenuhnya).
• 6.3 Final Interpretation: In the event of any discrepancy between the English and Indonesian versions of these terms, the** Indonesian version** shall prevail.
• (6.3 Interpretasi Akhir: Jika terdapat perbedaan penafsiran antara versi bahasa Inggris dan bahasa Indonesia, maka versi bahasa Indonesia yang akan digunakan sebagai acuan utama).
